Terms of Service
These terms are an agreement between you and Focus Created ("we," "us") covering the Focus Created app and the website focuscreated.com. By installing the app or using the site, you agree to them. If you use Focus Created for a company, you confirm you can accept these terms for that company.
1. What Focus Created is
Focus Created is a business management tool for service companies. It helps you find leads, place calls, send quotes, schedule jobs, manage crew, and track invoices. Your business data is stored on your device, as described in our Privacy Policy.
2. Your account and PINs
Access to the app is protected by PINs you control on your device. Keep them private. Anyone with your device and PINs can see and change your business data, and you are responsible for activity that happens through them.
3. Subscription, trial, and credits
- The app includes a free 7 day trial with full features. No payment method is required to start.
- After the trial, continued use requires a subscription, currently $29 per month, billed through Stripe on the web. Prices may change; we will give notice before a change affects you.
- Lead searches are metered in prepaid credits. Credits are consumed when the search returns leads, do not expire while your subscription is active, and are not redeemable for cash. When your balance reaches zero, searching pauses until you top up. Importing your own lead lists is free.
- You can cancel any time through the billing portal. Cancellation stops future charges; the current paid period runs to its end. Except where the law requires otherwise, payments and unused credits are not refunded.
4. Acceptable use
You agree not to use Focus Created to break the law, including telemarketing, spam, privacy, and consumer protection laws; not to harass anyone; not to contact people who have asked you to stop; and not to reverse engineer, resell, or copy the app or its content. We may suspend or end service for violations.
5. Compliance features are aids, not legal advice
The app includes safeguards such as call time windows, attempt caps, a Do Not Call list, email footers, and a sales tax lookup. These are conveniences built from general rules. They are not legal or tax advice, they may not cover every rule that applies to your business or location, and rules change. You remain fully responsible for complying with all laws that apply to your calls, messages, marketing, pricing, and taxes, and for confirming tax rates and taxability with a qualified professional.
6. Your data and backups
Your business data lives on your device. You are responsible for keeping backups using the app's export feature and for storing them safely. If your device is lost, damaged, or erased and you have no backup, the data cannot be recovered by us, because we never had it. If you encrypt a backup and lose the password, the backup cannot be opened.
7. Ownership
We own the app, the site, and everything in them except your data. Your business data is yours. We grant you a personal, non transferable license to use the app for your business while these terms are in effect.
8. Disclaimers
Focus Created is provided as is and as available. We do not promise it will be uninterrupted or error free, that lead results will be accurate or current, or that using it will produce any particular business outcome. To the fullest extent the law allows, we disclaim all warranties, express or implied, including fitness for a particular purpose.
9. Limitation of liability
To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or business interruption. Our total liability for all claims related to Focus Created is limited to the amount you paid us in the 12 months before the claim arose. Some places do not allow certain limits, so parts of this section may not apply to you.
10. Ending service
You can stop using the app and cancel your subscription at any time. We may suspend or terminate access for violation of these terms or for legal reasons. Sections that by their nature should survive, including 5 through 9, survive termination.
11. Changes to these terms
We may update these terms. If a change is material, we will note it on this page and update the date above before it takes effect. Using Focus Created after a change takes effect means you accept the updated terms.
12. Governing law
These terms are governed by the laws of the State of Florida, without regard to conflict of law rules. Disputes will be handled in the state or federal courts located in Palm Beach County, Florida, and you consent to their jurisdiction.
